1. Scope and Contracting Party

These General Terms and Conditions apply to orders placed via the MARELD online shop.

A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity.

An entrepreneur is a natural or legal person or a partnership with legal capacity that acts in the exercise of its commercial or self-employed professional activity when concluding a legal transaction.

2. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer to conclude a purchase contract, but an invitation to place an order.

You can initially place products in the shopping cart without obligation. Before submitting your order, you can review and change your entries using the correction options provided in the ordering process.

By submitting the order, you submit a binding offer to purchase the goods contained in the shopping cart.

After receiving your order, you will immediately receive an electronic confirmation of receipt of the order. This confirmation of receipt does not automatically constitute acceptance of your offer.

The purchase contract is concluded as soon as we expressly accept your offer, confirm the shipment of the goods, or ship the goods. If an earlier conclusion of the contract results from the payment method you have chosen, this remains unaffected.

3. Contract Language and Contract Text

The language available for the conclusion of the contract is German.

Information about your order will be provided to you as part of the ordering process. After placing your order, you will receive information about your order by email.

4. Products and Product Presentation

We strive to present and describe our products as accurately as possible.

In particular, the display of colors may deviate slightly from the actual appearance of the product depending on the screen used, its settings, lighting conditions, and other technical factors.

The respective product description and the properties agreed upon during the ordering process are decisive for the agreed quality of the goods.

Legal rights due to defects are not limited by technically caused display deviations.

5. Prices and Shipping Costs

All prices stated in the online shop are total prices in euros and include the statutory value-added tax, if applicable.

Additional shipping costs will be displayed before the order is completed.

For orders over €100, we deliver free of shipping costs within Germany.

6. Payment Methods

The available payment options will be displayed to you during the ordering process.

Payment processing takes place according to the payment method you have chosen and, if applicable, with the involvement of the respective payment service provider.

You are responsible for providing the information required for payment processing completely and correctly.

7. Delivery and Delivery Area

We deliver within Germany.

Delivery is made to the delivery address specified in the ordering process.

The estimated delivery time is specified for the respective product or in the ordering process. Since MARELD offers products from various brands and partners, the delivery times of individual items may differ.

Items from an order can be delivered in several packages and at different times. This will not incur additional shipping costs for you, unless additional costs were explicitly stated before the order was completed.

Should a delivery be significantly delayed or an ordered item exceptionally unavailable, we will inform you as soon as we are aware of this.

For consumers, the risk of accidental loss or accidental deterioration of the goods generally only passes when the goods are handed over to the consumer or a recipient designated by them. Statutory exceptions remain unaffected.

8. Retention of Title

The goods remain our property until full payment has been made.

9. Right of Withdrawal and Return Costs

Consumers generally have a statutory right of withdrawal for distance contracts.

MARELD will bear the direct costs of returning the goods in the event of an effective withdrawal.

10. Statutory Warranty Rights for Defects

The statutory warranty rights for defects apply.

If the delivered goods are defective, you are entitled to the statutory rights.

Voluntary guarantees from a manufacturer or other third parties do not limit your statutory defect rights against MARELD.

11. Liability

We are liable without limitation for damages resulting from injury to life, body, or health, which are based on an intentional or negligent breach of duty by us, our legal representatives, or vicarious agents.

For other damages, we are liable without limitation in cases of intent and gross negligence.

In the event of a slightly negligent breach of an essential contractual obligation, liability is limited to the foreseeable, contract-typical damage. Essential contractual obligations are those obligations whose fulfillment enables the proper execution of the contract in the first place and on whose compliance the contractual partner can regularly rely.

Liability based on mandatory statutory provisions, in particular according to the Product Liability Act, remains unaffected.

12. Copyrights and Other Protective Rights

The content published in the MARELD online shop, in particular texts, photographs, graphics, logos, and other design elements, may be protected by copyright or other protective rights.

Any use beyond the legally permissible cases requires the consent of the respective rights holder.

Third-party rights to brands, product images, and other content remain unaffected.

13. External Links and Third-Party Services

Our online shop may contain links to websites and services of third parties.

The respective operators are responsible for the content of external websites.

If external service providers are used to carry out an order or payment, their conditions may additionally apply, insofar as these are effectively included in the respective contractual relationship.

Your statutory rights against MARELD arising from a purchase contract concluded with us are not limited thereby.

14. Consumer Dispute Resolution

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

15. Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the state in which they have their habitual residence.

16. Place of Jurisdiction for Entrepreneurs

If the contracting party is a merchant, a legal entity under public law, or a special fund under public law, the statutory provisions on permissible agreements on the place of jurisdiction apply.

For consumers, no place of jurisdiction deviating from the statutory provisions is agreed upon.

17. Final Provisions

Should individual provisions of these General Terms and Conditions be or become wholly or partially invalid, the legal consequences and the validity of the remaining provisions remain unaffected.

Changes to these General Terms and Conditions apply to future contracts from their publication or from the respective specified date.

For contracts already concluded, the version included at the time of conclusion of the contract generally applies.
