1. Scope and Contractual Partners

These General Terms and Conditions (GTC) apply to orders placed via the MARELD online shop at www.mareld.de.

A consumer is any natural person who enters into a legal transaction for purposes that cannot be predominantly attributed to their commercial or self-employed professional activity.

An entrepreneur is a natural or legal person or a legal entity that, when entering into a legal transaction, acts in the course of their commercial or self-employed professional activity.

2. Conclusion of Contract

The presentation of products in the MARELD online shop does not constitute a legally binding offer to conclude a purchase agreement, but rather an invitation to place an order.

You can initially add products to the shopping cart without obligation. Before submitting your order, you can review your entries and correct them using the functions provided in the ordering process.

By clicking the final order button, you submit a binding offer to purchase the goods contained in the shopping cart.

Upon receipt of your order, you will immediately receive an electronic confirmation of receipt of your order at the email address you provided.

This automatic confirmation of receipt does not, by itself, constitute an acceptance of your offer to purchase.

The purchase agreement is concluded as soon as we expressly accept your offer, confirm the shipment of the goods, or ship the goods.

To the extent that a contract is concluded at an earlier time due to the specific order and payment process for a particular payment method, this remains unaffected.

If an ordered item is exceptionally unavailable and therefore no contract is concluded, we will inform you. In this case, payments already received will be refunded immediately via the originally used payment method.

3. Contract Language, Contract Text and Order Confirmation

The language available for concluding the contract is German.

The essential information about your order, in particular the ordered products, their variants, quantities, unit prices, shipping costs and the total price, will be displayed to you before completing the ordering process.

After submitting your order, you will receive an order confirmation at the email address you provided.

We will make the contract confirmation with the legally required information available to you within the statutory period on a durable medium.

This includes the General Terms and Conditions applicable to your contract as well as the cancellation policy, including the legally required information on cancellation.

The GTC and cancellation information will be made available to you in retrievable form, in particular as PDF documents, as part of our electronic order communication.

You can save and print the submitted documents for your records.

For contracts already concluded, the version validly incorporated at the time of concluding the contract is generally applicable.

4. Products and Product Presentation

We strive to present all products in the MARELD online shop as accurately and clearly as possible.

The product descriptions contain the available information about properties, sizes, colors, materials and other product-specific features.

Please note that the display of colors and surfaces may differ slightly from the actual appearance of a product depending on the screen used, its settings, lighting conditions and other technical factors.

The agreed quality of the goods is determined by the respective product description and the properties agreed upon during the ordering process.

These notes do not limit your statutory rights regarding defects.

Size specifications and size charts are intended as a guide. Where available, additional information about fit can be found in the respective product descriptions.

5. Prices and Shipping Costs

All prices stated in the MARELD online shop are in euros and include statutory VAT, where applicable.

Additional shipping costs will be shown separately before completing the order.

For deliveries within Germany, the following shipping terms generally apply:

• Flat-rate shipping: €6.90
• Free shipping from an order value of €100.00

The shipping costs actually displayed in the ordering process before submitting the order and the stated total price are decisive.

6. Payment Methods and Payment Processing

The payment options available at the time will be displayed to you during the ordering process.

Payment will be processed according to the payment method you choose and, if applicable, with the involvement of the respective payment service provider.

Supplementary conditions of the respective payment service provider may apply to individual payment methods, provided they are validly agreed upon.

You are responsible for providing the information required for payment processing completely and correctly.

The time at which your payment method is charged depends on the chosen payment method and the payment terms applicable thereto.

7. Delivery, Delivery Area and Delivery Times

MARELD delivers within Germany.

Delivery will be made to the delivery address you provided during the ordering process.

The estimated delivery time will be displayed for the respective product or in the ordering process.

As MARELD offers products from various brands and suppliers, the delivery times for individual items may vary.

If an order contains items with different delivery times, they may be delivered in multiple packages and at different times.

This will not incur any additional shipping costs for you, provided that corresponding costs have not already been expressly stated before completing the order.

The stated delivery times take into account the processing and transport time provided for the respective goods.

If there is a significant delivery delay or an ordered item is exceptionally unavailable, we will inform you as soon as we become aware of this.

Your statutory rights in the event of a delivery delay or non-delivery remain unaffected.

For consumers, the risk of accidental loss or accidental deterioration of the goods generally passes only upon delivery to the consumer or a recipient designated by them. Statutory exceptions remain unaffected.

8. Retention of Title

The delivered goods remain our property until full payment has been received.

9. Right of Withdrawal and Return Shipping Costs

Consumers generally have a statutory right of withdrawal for distance contracts, unless there is a statutory reason for exclusion.

The statutory withdrawal period is generally 14 days.

Details on the start of the withdrawal period, the requirements, the exercise and the consequences of withdrawal can be found in our separate cancellation policy.

You bear the immediate costs of returning the goods if you exercise your statutory right of withdrawal.

This applies provided that we have properly informed you about the bearing of costs and no deviating agreement exists.

In the event of a valid withdrawal, we will refund the payments received, including the costs of the cheapest standard delivery we offer, in accordance with statutory provisions.

We are not required to refund additional costs incurred because you chose a different standard delivery than the cheapest one we offer.

We may refuse to issue a refund in accordance with statutory provisions until we have received the goods back or you have provided proof that you have returned the goods, whichever occurs earlier.

We generally use the same payment method for the refund that you used for the original transaction, unless expressly agreed otherwise.

Your statutory rights regarding defective goods remain unaffected by the right of withdrawal and the provisions on return shipping costs.

10. Statutory Liability for Defects

The statutory liability for defects applies to all goods offered in the MARELD online shop.

If delivered goods are defective, you have statutory rights.

These include, subject to statutory requirements, in particular supplementary performance and, if applicable, withdrawal from the purchase agreement, reduction of the purchase price, or damages.

The statutory provisions on the limitation periods for defect claims apply without restriction, unless a legally permissible deviating agreement has been made.

Voluntary warranties provided by a manufacturer or other third party may exist in addition to your statutory rights and do not limit them.

The costs of a justified defect claim are governed by statutory provisions. The provisions on return shipping costs in the event of a statutory withdrawal do not apply here.

11. Liability

We are unlimitedly liable for damages resulting from injury to life, body, or health caused by an intentional or negligent breach of duty by us, our legal representatives, or our vicarious agents.

For other damages, we are unlimitedly liable for intent and gross negligence.

In the event of a slight negligent breach of an essential contractual obligation, our liability is limited to foreseeable, contract-typical damages.

Essential contractual obligations are those whose performance makes the proper execution of the contract possible in the first place and whose compliance the contractual partner may regularly expect.

Otherwise, our liability for damages caused by slight negligence is excluded to the extent permitted by law.

Liability under mandatory statutory provisions, in particular under the Product Liability Act, as well as under an expressly assumed warranty, remains unaffected.

12. Copyrights and Other Intellectual Property Rights

The content published in the MARELD online shop, in particular texts, photographs, graphics, logos, design elements, and other content, may be protected by copyright or other intellectual property rights.

Use beyond the cases permitted by law requires the prior consent of the respective rights holder.

Third-party rights in trademarks, product images, product descriptions, and other content remain unaffected.

The products offered in the online shop are presented under the respective brand names of the manufacturers or rights holders.

13. External Links and Third-Party Services

Our online shop may contain links to external websites and third-party services.

The respective operators are responsible for the content of external websites.

If external service providers are used to process an order, handle payment, or deliver goods, their terms may additionally apply to the extent that they are validly incorporated into the respective contractual relationship.

This does not limit your statutory rights against Pixelbox15 UG (haftungsbeschränkt) arising from a purchase agreement concluded with us.

14. Consumer Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

15. Applicable Law

The law of the Federal Republic of Germany applies to the contractual relationships between you and us, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by the mandatory provisions of the law of the state in which they have their habitual residence.

16. Jurisdiction for Entrepreneurs

If the contractual partner is a trader, a legal entity under public law, or a special fund under public law, the statutory provisions on permissible jurisdiction agreements apply.

For consumers, no jurisdiction other than that provided by statutory provisions will be agreed upon.

17. Final Provisions

If any individual provisions of these General Terms and Conditions are invalid or become invalid in whole or in part, the validity of the remaining provisions and the statutory consequences thereof remain unaffected.

Statutory provisions apply in place of invalid provisions.

Changes to these General Terms and Conditions apply to future contracts from the time of their publication or from the respective time stated.

For contracts already concluded, the version validly incorporated at the time of concluding the contract generally applies.
